The Music Press — Terms of Service
Last updated: [insert date]
These Terms of Service explain how you may use our website and the terms that apply when purchasing CDs, vinyl LPs, DVDs and other physical products from The Music Press. Please read them before placing an order.
1. About us
The Music Press is operated by Hey Rusty Ltd, trading as The Music Press.

These terms apply to purchases made by consumers for personal use.
2. Using our website
You must use our website lawfully. You must not attempt to compromise its security, introduce malicious software, misuse another person’s account or payment details, or interfere with its operation.
If you create an account, please keep your login details secure and contact us if you suspect unauthorised access.
3. Product information
Please check the product description before ordering, including the artist, title, format, edition and any stated DVD region restrictions.
We aim to provide accurate descriptions and images. Colours may appear differently on different screens. Any material differences in an edition, packaging or product specification will be stated in the listing.
We will not substitute a materially different product without your agreement. Products must match their description, be of satisfactory quality and be fit for their intended purpose.
4. Prices and payment
Prices are displayed in the currency shown on our website and include applicable taxes unless clearly stated otherwise. Delivery charges and any other applicable charges will be shown before you complete your purchase.
Payment must be made using an available checkout method. You must be authorised to use the payment method provided.
Price changes do not affect orders we have already accepted.
5. Placing and accepting orders
Please check your order and delivery details carefully before completing checkout.
Your order is an offer to purchase the selected products. An automated order acknowledgement confirms that we have received your order; it does not constitute acceptance.
We accept your order when we send you a dispatch confirmation. At that point, a contract is formed for the products included in that confirmation.
Before acceptance, we may decline an order if a product is unavailable, payment cannot be authorised, there is a genuine pricing or description error, or there are reasonable grounds to suspect fraud. We will contact you and refund any payment taken for products we cannot supply.
If we discover an error before accepting your order, we will explain it and give you the option to proceed on the corrected terms or cancel. We will not charge an additional amount without your agreement.
6. Availability and pre-orders
Products are subject to availability. If we cannot fulfil your order, we will let you know promptly.
For pre-orders, release dates and expected dispatch dates will be shown where available. These may change if the release is delayed. We will notify you of material changes, and you may cancel before dispatch for a refund.
7. Delivery
Available delivery options, charges and estimated timescales will be displayed before checkout.
Unless we agree a different delivery period with you, we will deliver your products within 30 days of accepting your order. A different period may apply to a pre-order where this is agreed when ordering.
Please contact us if your order is late, missing or damaged. We remain responsible for goods in transit until they are delivered to you or a person you nominate, subject to any applicable legal exceptions.
Delivery delays do not remove your statutory cancellation or refund rights. Where you have a legal right to cancel because of a delivery failure, we will refund the relevant payment.
8. Cancellations, returns and refunds
Our Returns & Refund Policy forms part of these terms.
We offer a voluntary change-of-mind returns policy for eligible products within 30 days of purchase, subject to the conditions in that policy.
For eligible online purchases, you also have a statutory right to notify us of cancellation within 14 days after delivery and then return the products within a further 14 days.
The statutory change-of-mind cancellation right does not apply to sealed audio or video recordings once you have broken the seal. This does not affect your rights where a product is faulty, damaged or not as described.
Our voluntary returns policy does not shorten your statutory deadlines or restrict your consumer rights.
9. Faulty or incorrect products
If a product is faulty, damaged on arrival, incorrectly supplied or not as described, please contact us so we can resolve the issue.
You may be entitled to a refund, repair or replacement under consumer law. We will cover reasonable return costs where required.
Opening a product to discover a fault does not remove these rights.
10. Promotions
Specific conditions for discounts and promotions will be displayed with the offer. Please check any expiry dates, exclusions or eligibility requirements before ordering.
Promotional pricing does not affect your statutory rights.
11. Website content and intellectual property
Website text, images, logos and other content belong to The Music Press or their respective rights holders.
You may browse our website and save or print information for personal use. You must not reproduce or commercially exploit protected content without permission, except where permitted by law.
Buying a CD, record or DVD does not transfer copyright or other intellectual property rights in its recordings, artwork or associated material.
12. Privacy
Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains our use of cookies and similar technologies.
13. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to exercise reasonable care and skill.
Products are supplied for personal use. We do not accept liability for business losses arising from their use, including lost business profits or business opportunities.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Your statutory consumer rights remain unaffected.
14. Changes to these terms
We may update these terms from time to time. The version available when you place your order will apply to that order.
15. Complaints and applicable law
If you have a complaint, please email info@themusicpress.co.uk with your order number and details of the problem. We will investigate and work with you to resolve it.
These terms are governed by the law of England & Wales. This does not remove any mandatory consumer protections that apply where you live or restrict your right to bring proceedings in a court available to you under applicable law.
